Failure to comply with the provisions of the Employment Equity Act (which includes the submission of Reports and drafting of Plans) may lead to the following fines as stated in schedule 1 of the EE Act:
CONTRAVENTION & FINE
No previous contravention R500 000
A previous contravention in respect of the same provision R600 000
A previous contravention within the previous 12 months R700 000
Three previous contraventions in respect of the same provision within 3 years R800 000
Four previous contraventions in respect of the same provision within 3 years R900 000
These fines are in the process of being amended to 2 -10 % of the Employers Annual Turnover.
