Everything you need to know to fast track your Liquor Licence Application

Liquor licensing in South Africa is a minefield. It seems as if each province has a different set of rules. Not only that, but each of the many licence types has more rules than we mere mortals can make sense of. That's why we commissioned an in-depth interview with one of South Africa's leading lawyers in this field. Peter Bowen and Peter Carruthers interview Jurie Zietsman, and pummel him with questions about the licensing process, as well as the small business issues that surround the application. Almost all liquor licences are going to take from 3 to 8 months to arrive - if all goes well.

That's after you've submitted the correct documents, and they're in order. It takes a few months to gather those documents - before submitting your application. By the time the process is complete, you will have spent hundreds of hours massaging your licence through the various facets of the application process. Many of the procedures we discuss in this recording are not in the official documentation, but without fulfilling the individual requirements of each province, you're going to be going back and forth for a very long time. I was horrified to discover via the DTE (development of tourism enterprises) website that strictly speaking, even if you as a guesthouse/whatever business, provide alcohol for no remuneration that you have to have a liquor licence, as the wording on the licensing is supply - there is no qualification of for remuneration or sale of! There are 15 different types of liquor licence in South Africa. We cover all the licence types for every situation:

  • restaurants, bistros, and other eating establishments;
  • nightclubs;
  • taverns;
  • bottle stores;
  • hotels, guesthouses, and other accommodation establishments;
  • special events and temporary liquor licences, indoor and outdoor;
  • FIFA related; 
  • pubs;
  • wine farms;
  • wine, beer, and spirit manufacturing;
  • clubs;
  • beer, wine and/or spirits;
  • new liquor licence applications;
  • liquor licence transfers;
  • liquor licence renewals.

Real Life Experience 3
Eventually had to take the liquor board and the SAP to the high court in end of Feb to get a hearing date, then again the for the hearing with all the objectors being present. We won the case and thought our woes were over.. We still don't have the license from the liqour board, but we keep copy of that judgement up framed on the wall, just in case, and have been trading since. These opening/closing issues have killed our trade as clients are now wary to change their "local" again, so business has been very slow. Also, its amazing how quickly rumours fly in a small town about you being too broke to stock that's why the doors are closed, etc. Kevin
